1Parties to the contract

This service is provided by 秋利所股份有限公司, the company that operates Enkkor (Unified Business Number 90209938; referred to below as “we”). “You” means the individual or company that creates an account and uses this service.

If you create an account on behalf of a company, doing so means that you have the authority to accept these terms on that company’s behalf, and that these terms are binding on that company.

2Account

  • The only way to sign in is with a Google account. We do not store passwords, and there is no password reset process, because there is no password to reset.
  • One Google account corresponds to one organization. You are responsible for the security of the account, including the actions of every member you authorize to join the organization.
  • You must provide accurate contact information and update it when it changes. Payment notices and important notices are all sent to this email address.

3The content you upload

The copyright in the videos, text, images and lists you upload remains yours (or the original rights holder’s). We will not acquire ownership of them.

To provide the service, you authorize us to store your content, convert its format, produce a transcript of it, and generate from it the derived content of this service (the timeline, messages, polls, event page images and so on). This authorization is limited to providing the service itself, and it ends when you delete the content or terminate your account.

You warrant that you hold all the rights needed to upload this content, including the consent of every person who appears in the video. We do not check this for you.

4System-generated attendees and messages

Please read this clause to the end. The core function of this service is to generate, based on the content of your recording, a set of fictional attendee personas, their messages, poll responses and purchase notifications, and to play them while the webinar is running.

  • These personas are not real people, those messages are not the opinions of real customers, and those purchase notifications do not correspond to real orders.
  • What people who registered type in the room is real; those are real attendees. The two kinds of message, real and generated, appear in the same chat.
  • How you present the webinar, and whether you disclose to your attendees that it contains generated content, is yours to decide, and is your responsibility.
  • You must comply with the provisions of the Fair Trade Act (公平交易法) of the Republic of China (Taiwan) on false advertising and misleading representations, and with the other rules of the industry you belong to. Promoting generated purchase notifications as real sales results is illegal, and it is you who breaks the law.

The generated content belongs to you. But it is written by a machine: it will make mistakes, it will misunderstand your video, and it may write sentences that do not match the facts. Reading every line before you go live is your job; this service lays every line out in the console for you to change for exactly this reason.

5Fees

  • The monthly fee is charged in advance at the start of each billing cycle and is not refunded in proportion to usage.
  • The number of attendees each month is capped at the number stated in your plan: each person who entered a webinar during the month is counted once; once the cap is reached, all of the account’s registration pages stop accepting registrations until the following month or until the plan is upgraded, and people who have already registered can still enter.
  • All prices shown are in New Taiwan dollars, before tax. If you need an e-invoice, tell us after you create your account.
  • An account whose payment fails and is not made good after we notify you becomes read-only: webinars that are already live keep serving your attendees, and the console stops generating and publishing.

The full plan details and prices are on the pricing page. When we change prices we will give notice in advance, and the change does not affect the current cycle that has already been paid for.

6Points

Generation features are charged in points: a transcript is charged by the length of the video, at 25 points per minute; generating live content costs 1,000 points each time.

  • The points your plan grants each month are valid for 60 days from the date they are granted, and drop to zero after that.
  • Annual bonus points and points you top up separately are valid for 12 months from the date you receive them.
  • Other features that use AI are charged separately: an AI draft of any one block of the event page costs 200 points each time, generating Moderator Q&A costs 450 points each time, and picking images from the video costs 300 points each time; replacing the video is charged the transcript points for the length of the new video, plus 1,000 points. When nothing is produced or the run fails, no points are charged.
  • Regenerating live content: the first time for each webinar is free, and each time after that costs 1,000 points.
  • Each charge uses the points granted by your plan first, then the points you topped up.
  • Points cannot be exchanged for cash and are not refunded.

7What you may not do

  • Upload content you have no right to upload, or content that infringes another person’s copyright, portrait rights or privacy.
  • Use this service for purposes that are illegal, fraudulent, or liable to mislead consumers into making a transaction decision.
  • Circumvent plan allowances, metering or access controls, or attempt to access data that does not belong to your organization.
  • Resell or sublicense this service, or scrape this service’s pages in bulk by automated means.

8Availability of the service

We make no commitment about uptime, because we have not yet built up an operating record that could support a figure, and writing a figure that has never been measured into a contract is worse than writing none. This service is currently provided “as is”.

We will give advance notice of planned maintenance. For unplanned outages, we will fix them as quickly as we can and explain the cause.

9Termination

You may terminate at any time, effective at the end of the current period; fees already paid for the current period are not refunded. Your data can be exported within 30 days after termination; after that we will delete it.

If you seriously or persistently breach clause 7, we may suspend or terminate your account after giving notice. In cases involving illegality or immediate harm to others, we may suspend first and notify afterwards.

10Limitation of liability

To the maximum extent permitted by law, our total liability to you for damages is capped at the fees you actually paid us in the 12 months before the claim arose.

We are not liable for indirect damage, loss of profits, business interruption, or damage arising from errors in system-generated content. This clause does not exclude liability arising from our intentional acts or gross negligence.

11Governing law and jurisdiction

These terms are governed by the laws of the Republic of China (Taiwan). For disputes arising from these terms, both parties agree that the Taiwan Taipei District Court is the court of first instance with jurisdiction.

12Changes to these terms

When we change these terms, we will update this page and change the date at the top of it. For changes that materially affect your rights, we will notify you by email before they take effect. If you continue to use this service after a change takes effect, you are deemed to have agreed to it.

If you have questions about these terms, write to hi@enkkor.com.
